Every architecture and engineering firm carries professional liability coverage, and most principals assume that policy answers for the environmental questions their work raises. It often does not. Inside nearly every standard A&E professional liability form sits a pollution exclusion — frequently absolute — that removes coverage for bodily injury, property damage, and cleanup costs arising out of pollutants. The exclusion stays invisible until a claim tests it. Understanding where that line falls, and how to bridge it, is one of the more consequential exercises a design firm can undertake this year.

The exclusion hiding in plain sight

Pollution exclusions use deliberately broad language. A representative form denies any claim "arising out of" the testing for, monitoring, or cleaning up of pollutants — the exact activities an environmental consultant is paid to perform. The industry has litigated this, and courts have sided with insurers. In James River Insurance v. Ground Down Engineering, a court upheld the exclusion even though the consultant's entire business model involved the excluded work, reasoning that the policy still covered some professional services and was therefore not illusory. The lesson for design firms is uncomfortable: a policy written for your profession can quietly exclude the risks your profession creates.

Two different products, two different jobs

Closing the gap starts with distinguishing the coverages that address it. Contractors pollution liability (CPL) responds to pollution conditions arising from covered operations — think a remediation contractor mobilizing equipment on a contaminated site. Professional environmental liability, sometimes packaged as contractors professional and pollution liability, pairs your errors-and-omissions exposure with pollution coverage for the design and consulting decisions that cause a release. Carriers such as AXA XL structure these as combined forms precisely because the two exposures travel together — a flawed remediation design and the contamination it fails to contain are one event to a claimant, even if they are two different policies to an underwriter.

Which disciplines carry the exposure

Geotechnical, environmental, and civil engineers sit closest to the hazard. A geotechnical firm that mischaracterizes subsurface conditions can mobilize buried contamination. An environmental consultant's Phase I or remediation design is, by definition, pollution work. Civil engineers designing stormwater, landfill, or brownfield redevelopment touch pollutants as a matter of routine. For each, the standard professional policy's pollution exclusion can convert a covered design error into an uncovered environmental loss — the same mistake, reclassified out of coverage by a single clause.

PFAS: the exposure underwriters watch most

No environmental issue is reshaping the landscape faster than PFAS. In April 2024 the EPA finalized drinking-water limits of 4 parts per trillion for PFOA and PFOS and 10 ppt for several related compounds; by the agency's own estimate, roughly 6 to 10 percent of about 66,000 public water systems will need remedial action. One month later the EPA designated PFOA and PFOS as hazardous substances under CERCLA, effective July 2024 — and in September 2025 it confirmed it would retain those designations. CERCLA imposes liability without fault and often on a joint-and-several basis, meaning a firm can be pulled into a cleanup for a minor contribution made decades ago. Insurance Journal reports PFAS is now the single largest concern for pollution underwriters. ACEC's carrier survey notes that while no A&E PFAS claims had surfaced as of the last review, insurers may add exclusionary language preemptively, and design firms could face cross-claims when PFAS is detected on their project sites.

Mold, indoor air, and the wider environmental map

Environmental exposure extends well past PFAS. Mold and indoor air quality claims — including Legionella — remain a persistent source of loss, and specialty markets now write dedicated indoor-air-quality and mold forms because standard general liability and professional policies exclude them. Every design decision that shapes moisture, ventilation, or material selection carries a latent environmental question that professional liability alone will not answer.

The market context

The timing favors intentional firms. A&E professional liability claim severity has climbed sharply — average losses on the first $1 million of coverage nearly doubled from roughly $260,000 in 2019 to $500,000 in 2023, with defense costs up 57 percent over the decade. Environmental capacity, by contrast, remains available, though carriers anticipate pressure on general and pollution legal liability rates into 2026. That combination — rising professional severity alongside accessible environmental capacity — is exactly the runway a firm wants when structuring coverage before a claim forces the conversation.
